Create Design are delighted to announce that the planning committee at the London Borough of Wandsworth unanimously approved our proposal to erect 17 flats on the site of the former British Lion Pub.
The site is located in the Vauxhall, Nine Elms, Battersea Opportunity Area and on a prominent corner to the entrance of the unique Carey Gardens housing estate.
The approved design, whilst undoubtedly contemporary in its character, responds to the appearance of the surrounding developments through the strong horizontal emphasis and complementary material palette.

Create have gained planning consent for the conversion of a Grade II listed disused office building to become 14 highly sustainable residential apartments. The building started life as The Carriage house where horse drawn carriages were made, the Victorian steel and masonry details still existing. With some careful restoration we are bringing this wonderful building back to life including restoring the front façade to its former glory.

CREATE Design are proud to announce that the Planning Committee at the London Borough of Ealing endorsed their officer’s and GLA’s recommendation to approve planning permission and listed building consent for the restoration and extension of the White Hart Pub, a Grade II listed building and erection of a 103 bed hotel and flexible retail space with public realm and open space.
With it being the largest development the area have seen for many years, the Committee were particularly pleased with the quality of the design and the benefits that the development would bring to the local community, amongst these being the regeneration of the site, restoration of the pub, provision of public realm, provision of community facilities etc.
CREATE Planning’s success Office-to-residential conversion allowed despite policy conflict 24.08.2021

CREATE Planning achieved approval for the conversion of an office to a two-bedroom apartment in a key office area of southwest London was approved despite conflict with local plan policies aiming to retain employment uses.
Comments from the Council and the inspector.
The proposed development would result in the loss of a small office unit to residential use. The inspector held that whilst this would run against the 2018 local plan which strictly protected this office in this area from the change of use proposed, it would be in accordance with the broader policy provisions concerning offices in the more recently published 2021 London Plan which supported the release of surplus office floorspace to other uses including residential.
The council had argued the office was not surplus because it had lost over 30 per cent of office floorspace since 2017 and had made Article 4 Directions to prevent changes of use under the GPDO. However, because of the particular circumstances of this case, the inspector held the proposed change of use would not materially harm the range of office premises, particularly for small and medium sized business activities in the borough’s centres, which the local plan sought to protect. These circumstances included the fact the office could be lost under Class E of the GPDO to another commercial, business or service use without planning permission anyway and the size of this office, its non-level access and displaced parking resulted in it having been unsuccessfully marketed for office use for over two and a half years, making a conversion under the new Class E more likely.
Furthermore, the inspector felt the change of use to residential would reduce the risk of harm from potential alternative commercial uses under Class E to the living conditions of occupiers above and below the appeal unit in the same block. He concluded it would add one further dwelling to housing supply and it would contribute to affordable housing in the borough, social benefits which weighed in favour of the proposal.

CREATE Planning’s success following a Public Inquiry on an enforcement appeal 02.05.2020
CREATE Planning acted as an expert witness and successfully challenged an enforcement notice, issued by LB Hackney in relation to an unlawful change of use of a warehouse to residential following the grant of prior approval. Enforcement action was issued and the prior approval notifications (for the ground floor and first floor) were deemed no longer valid on the basis that some operational work had taken place to the building (installation of and closing off windows and doors, erection of a fire escape staircase etc). A fall back position was not available as an Article 4 Direction was imposed following the issue of prior approval.
The appeal was successful under Ground C (i.e. lawfully implemented) in relation to the ground floor as the Inspector set out that provided the change of use was compliant with the approved plans internally, any other development that is done before/after/at same time does not invalidate that prior approval and therefore irrelevant whether or not the other operational works are started before use is implemented. This is significant for developers wanting to use prior approvals and undertake changes to the exterior as provided they comply with internal plans, only the external works are at risk of enforcement and not the use (and given they mostly improve the building are likely to be granted retrospectively anyway).
Ground C was not successful in relation to the first floor as this was found to be not validly implemented as a soundproofing condition was not complied with prior to commencement. However, Ground A was successful where, despite the studio units not meeting National Space Standards, a housing report on safety/fitness for use and evidence from the tenants were both instrumental on obtaining success.

CREATE Planning are delighted to have won a recent appeal for the erection of five high-end apartments within the prestigious settlement of Carlyon Bay. CREATE successfully argued that, despite concerns, no undue harm would occur on the existing neighbouring properties and that the development would make a positive contribution to the street scene. Of note is the fact that the Inspector ruled that exceeding a Five Year Housing Land Supply is not a reasonable reason to refuse an application when it accords with the Development Plan for an area. A common tactic used by those wishing to see a development proposal refused.

The dinner was followed by a talk from Jamie Fobert, who designed the Tate extension in St. Ives and was shortlisted for this year’s RIBA Stirling Prize.

CREATE makes PLANNING HISTORY 27.10.16
On 13 October 2016 CREATE received a High Court Judgment Quashing the Henfield Neighbourhood Plan. CREATE were part of the team that gained an allocation for a site location in Henfield allocated under a SHLAA in 2014 but it was subsequently excluded from the Neighbourhood Plan in 2016.
The site is subject to an appeal which hinges on the allocation in the Neighbourhood Plan. The Neighbourhood Plan was quashed in the High Court as The Hon. Mrs Justice Patterson DBE agreed with the case that Neighbourhood Plans need to be evidence based. This is the first successful appeal against a Neighbourhood Plan in the UK.
It will serve as a benchmark in ensuring such plans meet a high quality threshold and is victory for good design.
